The City of Clive (Clive) disclaims any warranties, express or implied, respecting the Mapping Service data, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The Mapping Service Data is provided "as is" without warranty or any representation of accuracy, timeliness, or completeness. The burden for determining accuracy, completeness, timeliness, merchantability and fitness for or the appropriateness for use rests solely on the User. The User acknowledges the Mapping Service Data is in a constant state of maintenance, correction and update.

Clive shall not be liable for any damages resulting from use of the Mapping Service or Mapping Service Data, including by not limited to, lost profits or consequential damages or claims against the User by third parties. The entire risk as to the quality, performance and usefulness of the Mapping Service and the Mapping Service Data rests with the User. The User releases Clive and its officers, agents, consultants, contractors, and employees from any and all claims, actions or causes of action for damages arising from or connected with the use of the Mapping Service or the Mapping Service Data. The User shall indemnify and hold harmless Clive and its officers, agents, consultants, contractors, and employees from any and all liability, claims or damages to any person or property arising from or connected with the use of the Mapping Service.
